DRIVE BY SHOOTING IN ROCKSPRINGS TEXAS
On November 22, 2015 at approximately 6:00 p.m. the Edwards County 911 phone system received numerous 911 calls in regards to shots being fired at multiple locations within the City of Rocksprings, Edwards County, TX. The Sheriff and the Deputies were immediately dispatched and responded to the area of Edwards Street and Price Street where witnesses described two vehicles involved: Silver Chevrolet Impala occupied by a two Hispanic males and Black male and a subject known as Paris Hubbard aka "PHub" aka "Mad Max". "PHub" is a known and documented gang member, CRIPS. He was the only reported subject who was did get injured during a gun battle with another vehicle listed a red Chrysler 300 occupied by 5 Hispanic males. According to Sheriff Elliott, "This was an extremely dangerous situation due to the total lack of disregard for life because children were in there yards innocently playing, but yet they had to witness this horrific event". Later another volley of gunfire again erupted in the 400 block of West Kerr Street in the City of Rocksprings when red Cadillac occupied 3 Hispanic Females and two children was fired upon. Sheriff Elliott, related that this incident appears to be retaliation, drugs and gang related activities".
Arrested - Tudy U. Rios, age - 28, Hispanic Male AND Timothy C. Rios, age - 27, Hispanic Male have been arrested for violations of the Texas Penal Code:
Sec. 22.05. DEADLY CONDUCT. (a) A person commits an offense if he recklessly engages in conduct that places another in imminent danger of serious bodily injury. (b) A person commits an offense if he knowingly discharges a firearm at or in the direction of: (1) one or more individuals; or (2) a habitation, building, or vehicle and is reckless as to whether the habitation, building, or vehicle is occupied. (c) Recklessness and danger are presumed if the actor knowingly pointed a firearm at or in the direction of another whether or not the actor believed the firearm to be loaded. (d) For purposes of this section, "building," "habitation," and "vehicle" have the meanings assigned those terms by Section 30.01. (e) An offense under Subsection (a) is a Class A misdemeanor. An offense under Subsection (b) is a felony of the third degree.
Sec. 22.041. ABANDONING OR ENDANGERING CHILD. (a) In this section, "abandon" means to leave a child in any place without providing reasonable and necessary care for the child, under circumstances under which no reasonable, similarly situated adult would leave a child of that age and ability. (b) A person commits an offense if, having custody, care, or control of a child younger than 15 years, he intentionally abandons the child in any place under circumstances that expose the child to an unreasonable risk of harm. (c) A person commits an offense if he intentionally, knowingly, recklessly, or with criminal negligence, by act or omission, engages in conduct that places a child younger than 15 years in imminent danger of death, bodily injury, or physical or mental impairment.
